Tradie Web Guys’ Terms and Conditions

Last updated 11/12/19. All prices include GST. These T&C’s are reviewed and updated regularly throughout year. For the sake of these Terms and Conditions, Tradie Web Guys will be referred to as TWG and clients will be referred to as clients.

Website Hosting and support

Support

1. Website Support/Care Plan

The cost of our Standard Website Hosting & Support is $88/mth (inc GST) and covers: • Questions on how to edit/add content to your site such as text, links, images, pages or posts. • Forgotten logins/passwords. • Access to training material. • Further clarification about information from TWG training programs and videos. Website Support does not cover: • Performing maintenance or edits to clients websites. These tasks will attract an hourly fee. Please contact us for details. • Setting up email on mobile, laptop or PC devices. • Technical support for Phones, Computers, IT and Internet help. • Performing work or support of third Party plug-ins or services such as PayPal, Facebook, YouTube, LinkedIn, Photoshop, Networked Blogs etc. Support TWG clients have access to support via email, phone and their account portal. Email is the preferred method as it provides a clearly documented definition of the scenario. Support is handled exclusively through support@tradiewebguys.com.au. Support is offered between 9:00am to 4:30pm Mondays to Fridays and urgent matters are attended to as a priority. *Websites have ‘uptime monitoring’ applied to them, maning we’re notified when they are down and when they come up. Typically speaking this only happens when there is a server updgrade happening. *Please note that support may be limited during Public Holidays or over the annual Christmas break. *During peak times, there may be a 24-48hr response time for any support.

2. Online store and cart feature websites

The cost of our Online Store Support and Hosting is $121/mth and covers: • Questions on how to edit/add content to your site such as text, links, images, pages or posts. • Forgotten log-ins/passwords • Further clarification about information from Tradie Web Guys workshops and tutorials. • Questions on how to edit/add/manage your products and online store Our Online Store Support does not cover: • Performing maintenance or edits to clients websites. Tradie Web Guys Training and Education

Online tutorials For the benefit of our clients, Tradie Web Guys create online tutorial courses that clients’ can access to learn about a range topics, such as managing your website and Google Apps for business. Many of these courses are provided as a free value add, however some of the more technical courses may be sold as products. Please advise, these courses are designed as a guide and the application of the content shall be used at the discretion of the viewer. Hosting

About hosting Tradie Web Guys offers hosting on all of the websites that we build. Tradie Web Guys’ websites are all hosted on private cPanel infrastructure with uptime monitoring and redundant scalability. Liability due to website performance and uptime Tradie Web Guys’ uses an advanced hosting infrastructure, based on performance and uptime. Occasionally, during server maintenance and website upgrades, websites may temporarily go down. Tradie Web Guys’ is not responsible for any downtime, nor related costs or damages associated with the website being down for any period of time. In any event of downtime, Tradie Web Guys will work closely with both the client and the suppliers to rectify any issues in a timely manner. Website Hosting It is advised that every Tradie Web Guys website must be hosted on the Tradie Web Guys Care Plan. Each Tradie Web Guys client is entitled to: • 20GB Website Hosting storage size with 20GB monthly bandwidth. Upgrades available. Each Online Store client is entitled to: • 20GB Website Hosting storage size with 20GB monthly bandwidth. Upgrades available. * Please note that whilst we use one of the the most reputable and stable hosting providers, Tradie Web Guys is not responsible for the the page load speed or downtime of hosting providers. Monthly Hosting Fee & Payment Terms Tradie Web Guys Managed Hosting fee is currently: $88/month (incl. GST + CC fees). Online store and cart feature websites are currently $121/month (incl. GST + CC fees). Clients will be asked for a credit card detail to be saved in Tradie Web Guys direct debit system prior to the projects completion. The monthly hosting fee is reviewed in annually and may be increased to reflect increased costs. Tradie Web Guys will notify all clients via email if there is to be a cost increase. Any such cost increase will take effect the following month. The monthly direct debits will be transacted on or about the 27th, or the 15th business day of each month (subject to weekends, public holidays, etc). The first payment will occur during the month following the receipt of the E-Debit form. Tradie Web Guys clients are responsible for any changes to their direct debit information and must inform Tradie Web Guys of any changes to their bank details. Please note if clients wish to pay via credit card, there will be a 2.00% surcharge for VISA and MasterCard and 4.00% surcharge for AMEX. Tradie Web Guys does not accept diners club. Backups Tradie Web Guys backs up the websites we build and host every day on a 30-day rotation. Declined payments If the automatic debit defaults, the client will be notified via email to inform them that their payment has been declined. The client will need to contact Tradie Web Guys immediately to rectify the issue within 14 days from the default email, otherwise the clients service(s) may potentially be suspended. This may include the website and emails going down and any running marketing campaigns to be suspended until payment is received in full. Penalty fees of $15 per transaction may incur as a result of the defaulted payments. Tradie Web Guys clients paying by automatic debit agree to pay all bank, reference, debt collection or legal fees associated with any default or legal proceedings to recover outstanding fees. Cancellation of the automatic debit requires one month’s notice in writing. Cancellation of hosting will result in the suspension and removal of the website from the time payment ceases. Release of Website After the launch of the website, the client must remain with Tradie Web Guys as their website provider for a minimum term of 12 months. Should a client request a release after expiry of the 12 month term, an administration fee may be levied in order to organise proceedings. Upon payment of the admin levy, Tradie Web Guys will provide a core either FTP access, or a website backup file. This file will be handed over to the client for their next web developer to implement. Tradie Web Guys is not responsible for any loss of data during this process. Tradie Web Guys is not responsible for the actual transfer of the website, nor the re-setup of email addresses and forwarders, all of which is the responsibility of the new provider. Once the transfer has been requested there is a 30 day window before the site and hosting will be removed from our server. Please also note that after the transfer, no online training videos or support will be available from Tradie Web Guys. Licenses Once the site has been moved off our servers, any programs that are under Tradie Web Guys license, like DIVI, Gravity Forms, SendGrid, etc will be removed and it will be the responsibility of the client to set up and replace with their own.

G Suite (formerly ‘Google Apps for Work’)

Google email As authorised resellers of Google’s G Suite, Tradie Web Guys is responsible for establishing many clients G Suite account. G Suite provides cloud based email, calendar, file storage, as well as many more business related functions. Tradie Web Guys recommends G Suite for many reasons, however in the event of any issues relating directly from Google themselves, Tradie Web Guys cannot be held responsible. Security G Suite has a very high level of security and encryption, which is more than enough for most organisations. Tradie Web Guys takes no responsibility for the loss of any data stored on Google’s servers, nor does it take responsibility for any information that finds it’s way into the wrong hands. Cloud storage Google Doc’s and Google Sites provide cloud based storage for files and documents. Information that you choose to store on Google servers are done so at your own discretion. Tradie Web Guys takes no responsibility for the loss of any data stored on Google’s servers, nor does it take responsibility for any information that finds it’s way into the wrong hands. Payment As authorised Google Apps resellers, Google bills Tradie Web Guys directly and Tradie Web Guys will bill our clients annually to the amount of $180AUD/account which includes our reseller support. Data migration Tradie Web Guys can migrate existing emails into your new G Suite account as an additional service, however please advise that we will not be held responsible for any loss of data that may occur during the process. This might include, but is not limited to; lost emails, lost attachments, lost documents, lost images, etc.

Other

Damage or Loss Tradie Web Guys (The Author) is not liable for any damage or loss caused to a website once it has been handed over to the client. We encourage our clients to be careful when editing / deleting pages as information can be easily lost. Tradie Web Guys is also not liable for any content that is on your website. Errors TWG can’t guarantee that our work will be error free (we’re human). For that reason, we can’t be held liable to you, or any third party for damages, including loss of profits, lost savings, or other incidental, consequential, or special damages, regardless of whether or not TWG was advised. TWG does however endeavour to work with you to resolve any issues. WordPress Every Tradie Web Guys website is built on WordPress, an open source CRM platform that we have found to be an excellent solution for our clients’ needs. Please note we neither own, nor control WordPress. Tradie Web Guys is not responsible for any disruption, loss of data or inconvenience caused by Word Press. Content Updates Content updates deemed outside of the general scope of works are quoted individually. This includes things like coding, adding, or changing text, images, video, etc. Any structural changes will be quoted separately and invoiced accordingly in advance. 3rd Party Plug-ins Tradie Web Guys uses 3rd party plugins such as Woo-Commerce, PayPal, Gravity Forms, Stripe, Facebook, etc to give our clients’ websites additional functionality. Please note we neither own, nor control any of these 3rd party plugins. Tradie Web Guys is not responsible for any disruption, loss of data or inconvenience caused by any 3rd Party Plugins that may exist on your website. Tradie Web Guys website display Tradie Web Guys websites feature a small hyperlink at the bottom of the footer. This is our way of spreading the word to other tradies. Failure to provide requested content and material In order to keep to project deadlines and not to hold up the production process, it is imperative that information requested by Tradie Web Guys is delivered within 7 days. This may be things like images, content, video, testimonials, etc. Failure to deliver the requested information for a period 15 days may result in the suspension of the project. Unsuspending projects will have an associated cost, based on what needs to be done to reinstate your asset. This will be payable upfront. You will be notified prior to this happening. If a project is suspended for 30 days, it will be terminated and no refunds will be applied. Your account will be purged from our system after this period. You will also be notified prior to this happening. Intellectual Property of website content Whilst Tradie Web Guys create and host the website, the websites structure, design and content (images and text) is owned and is the intellectual property of the client. Tradie Web Guys is not liable for any content that is on your website. Domain Name Ownership Whilst Tradie Web Guys manages the domain names for many of our clients via our reseller accounts at TPP Wholesale and Synergy Wholesale, legally each and every domain name remains the property of each of the client who is the rightful ABN/ACN holders of their business. Should any client wish to be released, Tradie Web Guys agrees to assist in releasing the domain name(s). Fee’s may apply for the cost of the domain renewal themselves, if accounts have not been settled.

Website Development Payment Terms

Initial Payment The first step for a new Tradie Web Guys website client is to accept the proposal, at which point the client will be asked for a 50% of the total of the total invoice amount. This needs to be settled by transfer, or credit card (fees may occur) prior to any work commencing. Once payment is received, Tradie Web Guys will commence work on the project. Final Payment The project balance is due prior to the website going live on the clients domain, along with any extras that the client may have opted in for along the way, such as images, copywriting, video, or other services, etc. In some cases, total payment may be due in one payment. These circumstances are under the discretion of Tradie Web Guys. Once this final invoice has been settled the website will be sent live onto the clients domain. In some cases this process can take up to three days for the DNS settings to propagate. Tradie Web Guys is not accountable for this period. Care Plan Payment You have 14 days once the website has been submitted for final revision to respond. After 14 days, your new website will be launched and your direct debit will commence. Cancellation If a client decides not to proceed with the website prior to any work having been commenced, Tradie Web Guys will provide a refund less an administration fee of 10%. No refunds will be provided once Tradie Web Guys commences work on a clients project, or strategy.

Marketing Payment Terms

Initial Payment Marketing packages such as SEO (Search Engine Optimisation) and Google Ads are paid a month in advance and are initiated once the first payment has been made. Google Ads management Tradie Web Guys charges a management fee to manage Google Ads campaigs. Search Engine Optimisation (SEO) Tradie Web Guys offer SEO as a service for our clients. Our SEO program has been highly refined and statistically returns excellent results over time, however we do not control the search engines, therefore cannot guarantee specific results. By partaking in an SEO program with Tradie Web Guys, you acknowledge that we are not and cannot be responsible for the position of any keywords in any search engine. Our promise to you is that we will work on your campaign, following our refined process to ensure you the best possible results. Cancellation Provided you’re not under any payment plan or obligation that owes Tradie Web Guys money, you’re free to cancel your program whenever you like, which will terminate your service at the end of your cycle. Refunds will not be applied.
